Please read these Terms and Conditions (“Terms”) carefully before using kitebuenhombre.com (the “Site”) or booking any lessons, equipment rentals, or tours (“Services”) with Kite Buen Hombre (“we,” “us,” “our”). By accessing the Site or booking our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or book our Services.

We are based in the Dominican Republic, and these Terms are governed by the laws of the Dominican Republic.

1. Our Services

​

We offer kitesurfing lessons, equipment rental, and kitesurfing tours/excursions (“Services”). Details, pricing, and availability of specific Services are described on the Site and may change from time to time without prior notice.

Return shipping is the customer's responsibility unless the item arrived defective or incorrect — in that case, we cover the return label and issue a full refund.

2. Assumption of Risk and Waiver of Liability

Kitesurfing and related water sports are inherently dangerous activities that carry a significant risk of injury, property damage, or death. By booking or participating in any Service, you acknowledge and agree to the following:

• Assumption of Risk: You voluntarily assume all risks associated with kitesurfing and related activities, including but not limited to risks arising from wind, water, and weather conditions, equipment failure, collision, drowning, and the actions of other participants, instructors, or third parties. These risks exist even when instruction, guidance, and equipment are provided with reasonable care.

• Physical Fitness: You confirm that you are physically fit and have no medical condition that would make participation unsafe. It is your responsibility to disclose any relevant health conditions to our instructors before participating.

• Release of Liability: To the fullest extent permitted by Dominican law, you release, waive, and discharge Kite Buen Hombre, its owners, instructors, staff, and affiliates from any and all liability for injury, death, or property damage arising from your participation in our Services, except where such injury, death, or damage results from our gross negligence or willful misconduct.

• Signed Waiver Required: Before participating in any lesson, rental, or tour, you will be required to sign a physical or digital waiver and release of liability form. Participation is conditional on signing this waiver. Nothing in this Section 2 replaces or limits the terms of that separate waiver, which you must also accept.

• Minors: Participants under the age of 18 must have the waiver signed by a parent or legal guardian, who assumes responsibility on the minor's behalf.

This Section 2 is a material part of these Terms. If you are not willing to accept these risks and release of liability, please do not book our Services.

3. Bookings and Payments

• Bookings for lessons, equipment rental, or tours can be made through the Site or by contacting us directly.

• Full or partial payment may be required at the time of booking to confirm your reservation, as indicated during checkout.

• Prices are listed in the currency shown on the Site at the time of booking and are subject to change without notice for future bookings; confirmed bookings will honor the price paid at confirmation.

• Payments are processed through our third-party payment processor. By providing payment information, you confirm that you are authorized to use the payment method provided.

4. Cancellation and Refund Policy

• No refunds: All bookings for lessons, equipment rental, and tours are final and non-refundable. Once a booking is confirmed and paid, no cash or payment-method refunds will be issued for any reason, including cancellation by you, no-shows, or failure to complete a Service once started.

• Rescheduling only: If you are unable to attend your scheduled Service, you may reschedule to a new date, subject to availability. Rescheduling requests must be made as far in advance as possible.

• One-year validity: Rescheduled bookings must be used within one (1) year of the original booking date. Any booking not rescheduled and used within this one-year period will expire with no further credit, refund, or extension.

• No-shows: Failure to show up for a scheduled Service without prior notice does not entitle you to a refund, and any rescheduling in this case is offered solely at our discretion.

• Cancellations by us: We reserve the right to cancel or reschedule any Service due to unsafe weather or wind conditions, equipment issues, or other circumstances beyond our control. In such cases, you will be offered the option to reschedule (within the one-year validity period above) at no additional cost; no cash refund will be issued.

• Weather-dependent nature of kitesurfing: Because kitesurfing depends on wind and weather conditions, we cannot guarantee specific conditions on any given day. Our instructors have sole discretion to modify, shorten, postpone, or cancel a session for safety reasons, and such adjustments do not entitle you to a refund.

By booking a Service, you acknowledge and accept this no-refund, reschedule-only policy.

5. Equipment Rental Terms 

• Rented equipment remains the property of Kite Buen Hombre at all times.

• You are responsible for the reasonable care of rented equipment during the rental period and agree to return it in the condition it was provided, normal wear and tear excepted.

• You may be charged for repair or replacement costs for equipment that is lost, stolen, or damaged due to misuse or negligence while in your possession.

• Equipment must only be used by the person(s) named on the rental agreement, and only in a manner consistent with instructions provided by our staff.

6. Instructor Authority and Participant Conduct

• Our instructors and staff have full authority to make safety-related decisions during any lesson or tour, including stopping a session at any time if conditions or participant behavior are deemed unsafe.

• Participants must follow all safety instructions given by our staff. We reserve the right to refuse service or remove any participant who does not comply with safety instructions, is under the influence of alcohol or drugs, or otherwise poses a risk to themselves or others, without refund.

7. Site Use

• You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by, any third party.

• All content on the Site, including text, images, logos, and graphics, is the property of Kite Buen Hombre or its licensors and may not be reproduced or used without our prior written consent.

8. Limitation of Liability

To the maximum extent permitted by Dominican law, Kite Buen Hombre’s total liability arising out of or related to your use of the Site or Services — for any cause of action whatsoever — shall not exceed the total amount you paid to us for the Service giving rise to the claim. We shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site or participation in our Services.

Nothing in these Terms limits liability that cannot be limited or excluded under applicable Dominican law.

9. Indemnification

You agree to indemnify and hold harmless Kite Buen Hombre, its owners, instructors, and staff from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your participation in our Services, or your negligent or intentional acts.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with a revised “Effective Date.” Continued use of the Site or booking of Services after changes are posted constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Dominican Republic. Any disputes arising from these Terms or our Services shall be subject to the exclusive jurisdiction of the competent courts of the Dominican Republic.
